1. Parties
This Short-Term Rental Agreement ("Agreement") is between 169 Precita Statutory Trust ("Host") and the registered account holder and all members of their party ("Guest"). This Agreement governs all short-term stays at the Property and constitutes a short-term occupancy license only. It does not create a tenancy, lease, or landlord-tenant relationship.
2. Property
169 Precita Ave, Lower Level, San Francisco, CA 94110. Guest's stay is limited to the lower level of the property as described in the listing.
3. Term of Stay
Stay dates and times are confirmed at booking. All times are Pacific Time (PT).
Check-in: 3:00 PM PT on your confirmed arrival date. No early check-ins without prior written approval.
Check-out: 10:00 AM PT on your confirmed departure date. No late check-outs without prior written approval.
Failure to vacate by check-out time will result in a charge of $250 per day for each day or portion thereof past the agreed check-out time.
4. Maximum Occupancy
Maximum occupancy is four (4) adults at all times. No children without prior written approval. Exceeding maximum occupancy is grounds for immediate termination of the stay and forfeiture of all payments.
5. Fees and Taxes
All applicable fees and taxes are displayed and confirmed at checkout before payment is processed. Fees include the nightly rental rate, San Francisco Transient Occupancy Tax (14%), San Francisco Tourism Improvement District Assessment Zone 2 (2%), and California State Rental Tax (15%). No security deposit is required.
6. Payment
All payments are processed through the booking platform at the time of reservation. Rental price is not negotiable after booking. Refunds are issued through the booking platform per the cancellation policy below.
7. Cancellation
Cancellations made 7 or more days before check-in: Full refund of prepaid rental amount.
Cancellations made fewer than 7 days before check-in: Forfeiture of the full prepaid rental amount.
Early departure: No refund for unused nights.
8. Smoking
This is a strictly non-smoking property. Smoking of any substance — including cigarettes, cigars, e-cigarettes, vaping devices, and cannabis — is prohibited anywhere on or within the Property. Violation results in immediate termination of the stay, forfeiture of all payments, and Guest liability for any remediation costs.
9. Pets
Pets are permitted only with prior written approval from Host and a signed Pet Addendum. Unauthorized pets are grounds for immediate termination and forfeiture of all payments. Guests with service animals must notify Host in advance and provide documentation.
10. Guest Responsibilities
Guest agrees to: remove garbage and place it in the designated outdoor receptacle; clean all dishes and cookware used during the stay; notify Host immediately of any damage or maintenance issue; lock all doors and windows when leaving; use all appliances only for their intended purpose; strip all used beds and leave towels in the bathrooms upon departure.
11. Noise and Conduct
Guest and their party must maintain reasonable noise levels at all times so as not to disturb neighboring residents. Guest is responsible for the conduct of all members of their party and any visitors they allow on the Property.
12. House Rules
Detailed house rules — including check-out procedures, parking, quiet hours, and WiFi — are available on the House Rules page of this platform. Guest agrees to comply with all House Rules as a condition of this Agreement.
13. Cleaning
A $50 cleaning fee is included in the booking charge, covering up to two hours of post-stay cleaning. Costs exceeding this amount due to Guest's actions will be charged to Guest. No housekeeping is provided during the stay. Linens and towels may not be removed from the Property.
14. Damage
Guest is responsible for any damage to the Property or its contents beyond normal wear and tear. Guest liability is not limited to the security deposit amount and extends to the full cost of repair or replacement.
15. Additional Charges
Electricity, water, gas, basic cable, and WiFi are included. Additional charges apply for: international or premium phone calls; pay-per-view or premium cable programming; fines or citations issued by the City of San Francisco or State of California arising from Guest's actions; damage to the Property; excessive utility consumption; cleaning beyond the included fee.
16. No Subletting
Guest may not sublet, assign, or transfer this Agreement or the right to occupy the Property. The Property may be used only as a short-term vacation rental and not for any commercial, business, or unlawful purpose.
17. Host Access
Host and authorized agents may access the Property with 24 hours' notice. Host may enter without notice in the case of emergency or credible report of illegal activity. Refusal to grant lawful access is grounds for immediate termination and forfeiture of all payments.
18. Prohibited Activities
No illegal drugs or controlled substances are permitted on the Property at any time. Violation is grounds for immediate eviction and forfeiture of all payments. Any illegal activity may be reported to law enforcement.
19. Liability and Indemnification
Host is not liable for any injury, loss, damage, or illness sustained by Guest or their party arising from use of the Property. Guest agrees to indemnify and hold Host harmless from any claim or liability arising from Guest's actions or breach of this Agreement. Host is not responsible for loss or theft of Guest's personal property. Guests are encouraged to purchase travel insurance.
20. Governing Law
This Agreement is governed by the laws of the State of California. The exclusive venue for any dispute is San Francisco County, California.
21. Breach and Termination
Failure to comply with any provision of this Agreement is grounds for immediate termination of Guest's right to occupy the Property, removal from the Property, and forfeiture of all rental payments.
22. Severability
If any provision of this Agreement is found unenforceable, the remaining provisions continue in full force and effect.
23. Modifications
Any exceptions or modifications to this Agreement must be approved in writing by Host before the check-in date. No oral modifications are binding.
By checking the box during signup and booking, you confirm that you have read, understood, and agreed to this Short-Term Rental Agreement and the House Rules in effect at the time of your booking. This acceptance is electronically recorded and is legally binding under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable California law.
